Adversary Proceedings – Lawsuits within a bankruptcy case

Lawsuits within a bankruptcy case – If your creditors want to object to your ability to obtain a discharge or the dischargeability of their debt they have to file a lawsuit within your bankruptcy and prove that either you are not entitled to a discharge or you have done something to warrant their debt from not being discharged.

Creditors Challenging your right to obtain a discharge – This is very serious and it is a separate matter from the main bankruptcy case. You must file an answer and defend yourself in the event that this happens. Even if you did not hire a lawyer or your bankruptcy lawyer does not handle litigation you need to hire a lawyer that knows what they are doing to defend you.
