Bankruptcy Trustee

in Chapter 7 and Chapter 13 bankruptcy your bankruptcy estate is governed by a court appointed trustee. You, the debtor, have no control over who your trustee will be, however your do have a legal duty to cooperate with the trustee if you wish to obtain a discharge, which is the point of bankruptcy after all. Make sure you keep this person happy. This does not mean that you have to bend to their will, there are times when the trustee takes a legal position that is contrary to your interests and you can oppose their position legally, however you do need to provide them with documentation and allow them access to inspect property that you own.

The duties to the trustee will be very different depending on the Chapter of bankruptcy which you file. Chapter 7 and Chapter 13 trustee’s perform different functions and have different duties.
